AI-Powered Tools

Some Dear Kate Brand Strategy products and free resources use artificial intelligence to analyze information you provide and generate customized outputs. These may include Scout, Website Writer AI, Homepage Hero Hatchet, and other tools we make available.

Depending on the tool, information submitted may include business descriptions, brand strategy, audience information, offers, pricing, founder stories, testimonials, website copy, client research, images, documents, website URLs, and other business-related content.

To provide these features, relevant information may be transmitted to third-party artificial intelligence providers, including Anthropic, OpenAI, and Google Gemini or related AI infrastructure.

Where we use commercial API services, information is processed according to the applicable provider's commercial terms. Our AI integrations are configured using commercial/API services under which submitted customer content is not used to train publicly available foundation models where such protections are provided by the applicable service.

AI-generated results may be stored in your account or our systems so you can access your work and continue using the product.

Website Analysis and Interactive Tools

Some tools allow you to submit a publicly accessible website URL for analysis.

When you submit a URL, you direct us to access publicly available information from that website. Depending on the tool, we may collect or process:

  • The URL you submit
  • Publicly available website text
  • Automated screenshots of the website
  • Extracted website copy
  • AI-generated analyses, recommendations, and rewritten copy

We do not use these tools to intentionally access password-protected or private website content.

Website analysis may be performed using third-party services such as Microlink or Firecrawl, as well as artificial intelligence providers.

You are responsible for ensuring that you have the right or authorization to submit any website you provide for analysis.

Uploaded Content and Testimonials

Some products allow you to provide client testimonials, customer research, photographs, stories, or other third-party content.

You are responsible for ensuring that you have the appropriate rights, permissions, and consents to provide that information to us and to have it processed through the applicable product.

Depending on the tool, this may include:

  • A screenshot of the application screen
  • Recent navigation activity within the application
  • Error messages and technical logs
  • Browser or device information

Screenshots may contain drafts or other information currently displayed on your screen. Diagnostic information is used to investigate and resolve support and technical issues.

Terms & Conditions

Last Updated: October 13, 2026

These Terms & Conditions ("Terms") govern your use of dearkatebrandstrategy.com and products, programs, digital tools, and services offered by Dear Kate Brand Strategy ("Dear Kate," "Company," "we," "us," or "our").

By accessing this website, creating an account, or purchasing or using one of our products, you agree to these Terms.

Educational Purposes

Dear Kate Brand Strategy provides website strategy, brand strategy, marketing education, templates, educational resources, and related tools.

Our products and services are provided for educational and informational purposes. Nothing provided by Dear Kate Brand Strategy constitutes legal, financial, accounting, tax, or other licensed professional advice.

You remain responsible for your own business decisions and for obtaining appropriate professional advice when needed.

No Guarantee of Results

We work hard to provide useful strategies, frameworks, tools, and educational resources, but we cannot guarantee specific business outcomes.

Purchasing or using a Dear Kate Brand Strategy product does not guarantee revenue, clients, bookings, conversions, website traffic, search engine rankings, audience growth, or other particular results.

Your results depend on many factors outside our control, including your business, market, offers, implementation, experience, audience, and decisions.

Testimonials and examples represent individual experiences and should not be interpreted as guarantees that you will achieve the same results.

Purchases and Digital Products

Dear Kate Brand Strategy sells digital educational products, templates, courses, software and AI-powered tools, and programs.

Product descriptions provided on the applicable sales or checkout page form part of the terms of your purchase.

Unless otherwise stated at the time of purchase, your purchase provides a limited license for your own individual or business use.

You may not reproduce, distribute, resell, sublicense, share, publish, or commercially redistribute our proprietary educational materials, templates, workbooks, prompts, frameworks, videos, course materials, or software.

Purchasing a product does not transfer ownership of Dear Kate Brand Strategy's intellectual property to you.

Website Writer Workbook and Educational Materials

Products such as the Website Writer Workbook, courses, worksheets, trainings, guides, and other educational resources are licensed to the purchaser for their own use.

You may use what you learn from these materials in your business and may use completed work you create through the exercises for your own commercial purposes.

You may not share, reproduce, sell, distribute, upload, publish, or provide copies of the underlying materials to others without written permission from Dear Kate Brand Strategy.

Templates

Website templates and other design templates are licensed rather than sold outright.

Unless a product description or separate license states otherwise, templates are licensed for use by the purchasing individual or business for one business.

Templates may not be resold, redistributed, shared, sublicensed, or represented as your own template product.

Any additional licensing terms displayed at purchase also apply.

Refunds

Because many Dear Kate Brand Strategy products include immediate access to digital materials, downloadable resources, templates, software, or intellectual property, purchases are non-refundable unless a refund policy or guarantee is specifically stated on the applicable sales page, checkout page, or below.

If a specific product includes its own refund policy, the terms of that policy apply to your purchase.

Brand Base Camp Refund Policy

Brand Base Camp includes a 7-day refund period, subject to your participation in and access to the program.

To qualify for a full refund:

  • Your refund request must be made within 7 days of purchase.
  • You must not have downloaded or accessed the included Showit Website Template or Blogging Mini Course.
  • You must not have attended a live Q&A call.

If you request a refund within the 7-day period but have accessed any of these resources, Dear Kate Brand Strategy reserves the right to deduct the retail value of the resources accessed from your refund.

Refund requests made more than 7 days after purchase are not eligible for a refund.

To request a refund, contact hello@dearkatebrandstrategy.com.

Nothing in this refund policy limits any rights that cannot legally be waived under applicable consumer protection laws.

Payment Plans

When a payment plan is offered, selecting the payment plan represents an agreement to pay the entire purchase price according to the stated payment schedule.

A payment plan is not a subscription that can be canceled simply by discontinuing use of the product.

If a scheduled payment fails, we may temporarily or permanently suspend access until the account is brought current.

Artificial Intelligence Tools

Some Dear Kate Brand Strategy products use artificial intelligence to help users develop brand strategy, website copy, marketing materials, imagery, or related business content.

These tools are intended to assist your thinking and creative process. AI-generated content should be treated as a draft or recommendation rather than independently verified professional advice.

Artificial intelligence can produce incorrect, incomplete, repetitive, misleading, or otherwise unsuitable information.

You are responsible for reviewing and editing AI-generated content and verifying factual statements, pricing, claims, statistics, legal statements, SEO recommendations, and other information before publishing or relying on it.

Dear Kate Brand Strategy does not guarantee the accuracy, originality, availability, or suitability of AI-generated content.

AI-Generated Content and Your Business Materials

You retain ownership of original materials you provide to our tools, including your writing, photographs, business information, research, stories, and other original content, subject to any rights belonging to third parties.

As between you and Dear Kate Brand Strategy, you may use, edit, publish, and commercially use outputs generated for you through our tools, subject to applicable law and the terms of any applicable third-party AI provider.

Dear Kate Brand Strategy does not claim ownership of your completed website copy, Field Guide, positioning statements, or other personalized business outputs.

However, Dear Kate Brand Strategy retains all rights to its pre-existing intellectual property, including its software, interfaces, prompts, systems, methodologies, educational materials, frameworks, templates, workflows, branding, and tool design.

AI-generated material may not qualify for copyright protection in all circumstances. You are responsible for determining whether and how intellectual property laws apply to your finished work.

Trademark and Name Clearance

Our tools may generate or suggest business names, product names, program names, taglines, headlines, phrases, or other branding ideas.

We do not perform trademark searches, common-law trademark searches, domain availability searches, or legal clearance of generated ideas.

Before adopting a business name, product name, tagline, program title, slogan, or other potentially protectable identifier, you are responsible for conducting appropriate research and obtaining legal advice when necessary.

Accounts and Licenses

Accounts for Dear Kate Brand Strategy software and AI-powered products are intended for the licensed purchaser.

You may not share account credentials, access codes, or paid product access with other individuals unless your license specifically permits it.

You may not resell access to our tools or use a personal-use license as a white-label service for clients.

Certain products may include specific project, brand, or usage limits. Those limits will be described on the applicable sales or checkout page and become part of your license.

Third-Party Content

If you provide testimonials, photographs, client information, research, website content, or other materials belonging to another person or business, you represent that you have the rights and permissions necessary to use and submit that material.

You are responsible for obtaining any necessary permission to use client names, likenesses, testimonials, photographs, or other protected information.

Submitted Websites

Certain tools allow you to submit website URLs for analysis or content extraction.

By submitting a website, you represent that you own the website or otherwise have authorization or a legitimate right to submit its publicly accessible content for analysis.

You may not intentionally use our tools to access or analyze private, password-protected, confidential, or unlawfully obtained information.

Acceptable Use

You may not use our website or tools to:

  • Engage in unlawful, fraudulent, deceptive, defamatory, or abusive activity
  • Violate another person's intellectual property or privacy rights
  • Attempt to gain unauthorized access to our systems
  • Reverse engineer our software or proprietary systems
  • Extract or reproduce proprietary prompts, workflows, or algorithms
  • Scrape or systematically copy our software or educational materials
  • Resell or redistribute access without authorization
  • Interfere with the operation or security of our services

We reserve the right to suspend or terminate access when we reasonably believe these Terms have been violated.

Service Availability

Some Dear Kate Brand Strategy products rely on third-party technology, including artificial intelligence providers, hosting services, APIs, payment processors, and other infrastructure.

We cannot guarantee uninterrupted or error-free access.

Features may occasionally be unavailable because of maintenance, third-party outages, API limitations, technical changes, or circumstances outside our control.

We may modify, replace, discontinue, or update features when reasonably necessary to maintain or improve a product.

Intellectual Property

Unless otherwise stated, the website and its original content, branding, text, graphics, educational materials, courses, templates, frameworks, software, and other proprietary materials are owned by Dear Kate Brand Strategy or appropriately licensed to us.

Nothing in these Terms transfers ownership of that intellectual property to you.

Third-Party Services and Links

Our website and products may integrate with or link to services operated by third parties.

We are not responsible for third-party websites, platforms, products, privacy practices, availability, or content.

Your use of third-party services may also be governed by those providers' terms and privacy policies.

Limitation of Liability

To the fullest extent permitted by applicable law, Dear Kate Brand Strategy will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use our website, products, tools, or services.

You are responsible for reviewing information and making your own business decisions before implementing strategies, recommendations, or AI-generated content.

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Dear Kate Brand Strategy from claims, damages, liabilities, and reasonable expenses arising from your unlawful use of our website or products, your violation of these Terms, or your infringement of another person's rights.

Privacy

Your use of our website and products is also governed by our Privacy Policy, which explains how information is collected, used, processed, and shared.

Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles.

Any dispute relating to these Terms or your use of our website or products will be handled in accordance with applicable law.

Changes to These Terms

We may update these Terms as our products, technology, or business practices change.

The "Last Updated" date indicates the most recent revision.

Your continued use of our website or products after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

Severability

If any portion of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

Entire Agreement

These Terms, together with any product-specific terms, checkout terms, license terms, and our Privacy Policy, constitute the agreement governing your use of our website and applicable products.

Product-specific terms presented at purchase control if they conflict with these general Terms.
